The Big Picture

Data center projects are testing whether existing permitting systems can adequately evaluate cumulative impacts across air, water, wastewater, heat, land disturbance, endangered ecosystems, and power infrastructure. The core issue is whether fragmented approval processes, public notice, disclosure credibility, NDAs, environmental impact reports, and sequencing between local approvals and later air, water, wetland, and utility permits provide enough transparency, accountability, and legal defensibility for very large facilities.
Permitting credibility affects community trust, litigation risk, project schedules, and regulatory legitimacy. As data centers scale beyond traditional industrial assumptions, agencies will face pressure to strengthen environmental review, disclosure, monitoring, and public participation.
